Election Law No. 9 (2005)

Article 10 states:

(1) An individual shall be deprived of the electoral right if he/she:

(a) Was deprived of that right by virtue of a final judicial decision throughout the term of such a ruling.

(b) Was declared incapacitated by a final judicial ruling.

 

Article 13 states:

An individual shall be deprived of the right to become a presidential candidate when he/she:

(1) Has been disfranchised.

(2) Has been denied the right to candidacy by virtue of a final judicial ruling passed by a competent Palestinian court throughout the term of the ruling.

Local Councils Elections Law No. 10 of 2005

Article 7 states:

The right to vote shall be practiced according to provisions of this law, for who shall fulfill the following conditions...

  • (4) He/she shall not be legally incompetent.

 

Article 40, paragraph 1 states:

If the voter is illiterate or disabled in a manner that would prevent him/her from marking the ballot paper by him/herself, he/she can ask the help of a second degree relative to mark for him the name of the list he dictates.

 

Article 59 states:

Vacant chairperson position:

(1) The chairman post shall be deemed vacant in the following cases: -

  • (a) Illegibility or incapacity to do duties according to absolute writ…
  • (c) If two thirds of the local council’s members cast a vote of no-confidence in the chairperson

(2) The deputy chairperson shall be invested powers of the chairperson until the election of a new council chairperson…

 

Article 60 states:

(1) The member's post shall be deemed vacant in the following cases: -

  • (b) Illegibility or incapacity to do duties according to absolute writ.

(2) The council shall announce vacancy of member post and inform the minister of local government

(3) The vacant post shall be filled by the member who came directly after last winner of the same list of whom the member whose post has become vacant belonged to.

(4)  If no member followed the last winner on the same list then a move is made to the other person who ranked behind the last candidate who received a seat upon the calculation of the results based on “Saint-Laguë” method.

Article 11 states:

In accordance with the provisions in Article (9) paragraph (3), if the position of the chairperson or member of the Commission  becomes vacant due to resignation, death, illness or any other reason, the chairperson shall appoint a new member within a maximum of two weeks from when the position becomes vacant.

 

Article 29, paragraph 1 states:

An individual shall be deprived of the electoral right if he/she:...

  • (b) was declared incapacitated by a final judicial ruling.

Article 37, paragraph 1 states:

The office of the President shall be considered vacant in any of the following cases:

(a) Death;

(b) Resignation submitted to the Palestinian Legislative Council, if accepted by two thirds of its members;

(c) Loss of legal capacity, as per a ruling issued by the High Constitutional Court and subsequently approved by a majority of two-thirds of the members of the Legislative Council.

 

Article 48, paragraph 2 states:

If the position of one or more Members becomes vacant due to death, resignation or loss of capacity, partial elections shall be conducted in the relevant district to elect a successor, in accordance with the law.
